SMS/Text Messaging Terms & Conditions

These SMS/Text Messaging Terms & Conditions ("SMS Terms") govern your participation in the text messaging program offered by The Backyard District LLC ("The Backyard District," "TBD," "we," "us," or "our"). By opting in to receive text messages from us, you acknowledge that you have read, understood, and agree to these SMS Terms and our Privacy Policy.

1. Program Description

The Backyard District may use text messaging to communicate with customers and prospective customers. Depending on how you interact with us and the permissions you provide, messages may include:

Responses to website inquiries, quote requests, appointment requests, and other questions;

Customer-care, showroom, order, delivery, installation, warranty, maintenance, repair, and service communications;

Product information and availability;

Appointment reminders and follow-up messages;

Promotional offers, sales, events, product launches, and personalized marketing relating to hot tubs, swim spas, saunas, cold plunges, water-care products, accessories, maintenance, repairs, and other products or services offered by The Backyard District.

2. Consent to Receive Text Messages

By providing your mobile telephone number and affirmatively opting in, you authorize The Backyard District to send recurring text messages to the number you provided. These messages may include promotional or personalized marketing messages and may be sent using an automatic telephone dialing system, automated technology, or similar technology.

Your consent is not a condition of purchasing any property, goods, or services from The Backyard District.

You represent that:

You are the subscriber or customary user of the mobile number provided, or you are authorized to consent to messages at that number;

The information you provide is accurate and current; and

You are at least 18 years old or have the permission of a parent or legal guardian.

If your mobile number changes or is reassigned, you agree to opt out before discontinuing use of that number or promptly notify us at [email protected].

3. Message Frequency

Message frequency varies based on your interactions with us, the services you request, and current promotions, events, and updates. You may receive multiple messages during an active inquiry, appointment, purchase, delivery, installation, or service matter. Promotional message frequency also varies.

4. Message and Data Rates

Message and data rates may apply to messages sent by The Backyard District and to messages you send to us. Any charges are determined by your wireless carrier and are your responsibility. Contact your wireless carrier if you have questions about your text or data plan.

5. How to Opt Out

You may revoke your consent and opt out of promotional text messages at any time by replying STOP to any text message from us. You may also use another reasonable method to communicate that you no longer wish to receive text messages, including contacting us at [email protected] or (954) 445-2550.

After we receive your opt-out request, we may send one final, non-promotional text message confirming that you have been unsubscribed. We will then stop sending messages covered by your request within the time required by applicable law.

If you receive different categories of messages from us, we may ask whether your request applies to all messages or only certain categories. If you do not clarify, we may treat your request as applying to all further text messages for which consent is required.

To re-enroll after opting out, reply START when available or submit a new opt-in request through one of our authorized sign-up methods.

7. Carrier and Delivery Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Text message delivery is subject to the effective transmission of messages by your wireless carrier and is not guaranteed. The Backyard District is not responsible for delays, delivery failures, technical errors, or other problems outside our reasonable control.

Participation in the program is subject to your carrier's terms and the capabilities of your mobile device and service plan.

8. Privacy

We respect your privacy. Information collected through the text messaging program will be handled according to our Privacy Policy.

No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Information may be shared with service providers and subcontractors that support our communications, customer care, CRM, scheduling, delivery, installation, service, or other business operations. All other use-case categories exclude text messaging originator opt-in data and consent. SMS opt-in data and consent will not be sold, rented, or shared with third parties for their own marketing purposes.

9. Program Availability and Changes

The Backyard District may suspend, modify, or discontinue all or part of the text messaging program at any time. We may also update these SMS Terms from time to time to reflect changes to our program, business practices, technology, or legal requirements.

When required, we will provide notice of material changes. The updated SMS Terms will be posted with a revised effective date. Your continued participation after an update becomes effective constitutes acceptance of the updated SMS Terms, to the extent permitted by law.

10. Termination

We may suspend or terminate your participation in the text messaging program if we believe you have violated these SMS Terms, misused the program, or engaged in unlawful, abusive, or fraudulent activity. Termination does not limit any rights or remedies otherwise available to us.

11. Governing Law

These SMS Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law applies or applicable law requires otherwise.

12. Severability

If any provision of these SMS Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
